1. Application of the Terms of Use 

“Youngster.co”, “us”, “we” or “our” means Learning Guide Pty Ltd (ABN: 99 620 347 668) trading as Youngster.co. These Terms of Use set out the terms on which you use the websites of Youngster.co (the “Website”). By accessing and using the Website, you accept these Terms of Use apply. If you do not agree to these Terms of Use, do not access or use the Website. 

These Terms of Use should be read together with our Privacy Policy which explains how we collect, use, disclose and manage your personal information. 

2. Changes to the Terms of Use 

We may amend or update the Terms of Use from time to time. Your access or use of the Website after an updated version of the Terms of Use has been made available on the Website indicates your acceptance of the Terms of Use as changed by us. We, therefore, encourage you to check this document regularly.

Unless otherwise indicated, and all materials displayed on the Website, including all content on the pages or screens of the Website, text, graphics, advertisements, names, logos and trademarks (whether registered or not) (collectively “Youngster.co Content”) are our property or the property of their respective owners, and are protected by copyright, trademark and other intellectual property laws. All Youngster.co Content and the Website are subject to changes or discontinuity at any time. Changes may include imposing limits on certain features or restricting your access to parts of the Website or Youngster.co Content. Whilst Youngster.co endeavors to keep the Website and Youngster.co Content updated, they are provided on “as is” basis. To the extent permitted by law, Youngster.co makes no representations or warranties about the accuracy, adequacy, completeness or currency of Youngster.co Content, and disclaims liability for any error, omission and your use or reliance on the Website and Youngster.co Content. 

4. Site security 

You acknowledge that the security of any data transmitted via the internet cannot be guaranteed. We cannot guarantee the security of any information you transmit to us via the Website. We do not warrant or represent that your access to the Website or emails received from us will be uninterrupted or error free or free of other harmful components. You must take your own precautions to ensure that your access to the Website does not expose you to the risk of any viruses, malicious computer codes or other forms of interference that may damage your computer system. 

5. No illegal use 

You agree to use the Website and Youngster.co Content for lawful purposes only and not post or transmit any information or material which in any way infringes or violates the rights of others or which is unlawful, defamatory, threatening, invasive of privacy or publicity, obscene, harassing or otherwise objectionable.

If you create an account with Youngster.co through the Website, you are responsible for maintaining the confidentiality of your account and password and you are responsible for all use of your username and password. Without limiting your responsibility, you must promptly advise Youngster.co of any disclosure of your account and password details, and any unauthorised use. Youngster.co accepts no liability for any unauthorised use of your account or password. 

7. Your Information 

You are responsible for all personal information you provide through the Website, including any documents or forms uploaded to, filled in and/or accepted by you within the Website (“Your Information”). We will handle Your Information in accordance with our Privacy Policy. 

You acknowledge and agree that: 

(a) the provision of Your Information is your own decision, at your own risk; and 

(b) neither Youngster.co or Youngster.co’s clients are responsible for identifying, verifying or seeking correction of errors or omissions in Your Information. 

8. Registration 

If you submit Your Information through the Website to register your interest in becoming a Youngster, i.e. a provider of technology assistance, or a partner or client, i.e. a recipient of technology assistance, you acknowledge and agree that: 

(a) Your Information submitted through the Website is complete, accurate, and any documents provided are authentic; 

(b) Youngster.co will assess your submission based on Your Information as submitted on the Website; 

(c) there is no commitment from Youngster.co regarding the submission for which you provided Your Information; 

(d) Youngster.co disclaims any liability in respect of job description or availability, or the availability of the technology services; and 

(e) By clicking ‘submit’ or applying your signature onto any document provided to you through the Website, either electronically, digitally or otherwise, you are 

legally accepting and/or confirming you have read and understood the terms provided to you and that the document becomes binding on you. 

9. Links from this Website 

Our Website may include links to other websites over which we have no control. We make no representations about the accuracy of information contained on those websites. We are not liable for the content on those websites. 

10. Australian Consumer Law 

Consumers have certain rights under the Australian Consumer Law and similar state and territory legislation, which include statutory guarantees that cannot be excluded, and nothing in these Terms of Use operates to exclude these statutory guarantees. To the extent permitted by law, Youngster.co’s liability under any such statutory guarantee is limited, at Youngster.co’s option, to replacement or resupply of goods or services, or payment of the cost of such replacement or resupply. 

11. Liability and indemnity 

To the maximum extent permitted by law, we exclude all liability to any person for any loss or damage, whether direct or indirect and however caused (including through negligence) that may be suffered as a result of use of the Website, including but not limited to any interference or damage to that person’s computer system which arises as a result of use of the Website, a linked website or receipt of emails from us. To the maximum extent permitted by law, we exclude any conditions or warranties that would otherwise be implied into these terms and conditions. Where a condition or warranty cannot by law be excluded, then that condition or warranty will be deemed included in these Terms of Use, but our liability in respect of any breach of that condition or warranty will be limited to the maximum extent permitted by law. 

12. Jurisdiction 

These Terms of Use are governed by the laws in force in New South Wales, Australia and you submit to the non-exclusive jurisdiction of the courts in that place. Dated: 30th June 2021
